<br />ORDINANCE NO. <br /> <br />b <br /> <br />-1983 <br /> <br />AN ORDINANCE REZONING REAL PROPERTY IN THE CIVIL TOWN OF MOORESVILLE, INDIANA <br /> <br />WHEREAS, the Mooresville Plan Commission has held a public hearing relative <br /> <br />to a petition for rezoning filed by Norman E. Whitney and Charlene Y. Whitney, <br /> <br />which petition ~as docketed with the Mooresville Plan Commission under number 1-1983, <br /> <br />and <br /> <br />WHEREAS, the Mooresville Plan Commission has recommended to the Board of <br /> <br />Trustees of the Civil Town of Mooresville, Indiana that the petition of Norman E. <br /> <br />Whitney and Charlene Y. Whitney be approved to rezone with reference to the following <br /> <br />described property from its present classification A-Residential to rezoning <br /> <br />classification AR-Agricultural Residential, which real estate is more particularly <br /> <br />described as follows: <br /> <br />Part of the Northwest quarter of Section I, Township 13 North, Range 1 East of <br />the Second Principal Meridian, Morgan County, Indiana, bounded and described <br />as follows, to-wit: <br /> <br />Beginning on the South line of the Northwest quarter of Section 1, township and <br />range aforesaid, at the Southeast corner of Lot No. 5 in "Charmil Estates" as <br />given in Deed Record 244, page 513, in the records of Morgan County, Indiana, <br />which is the BEGINNING POINT of this description: <br /> <br />From said beginning point run thence N 00°36' Walong the East line of said <br />Lot No. 5 a distance of 265.0 feet; run thence S 87°10' W along the North line <br />of said lot a distance of 115.42 feet to the circumference of a circle having <br />a radius of 50.0 feet; run thence northwesterly on the circumference of said <br />circle a distance of 157,08 feet to the Southeast corner of Lot No. 15 in <br />"Charmil Estates"; run thence N 02°41'13" W along the East side of said Lot <br />No. 15 a distance of 235,39 feet; thence run N 86°59'25" W a distance of <br />68.73 feet; run thence S 46°20' Wa distance of 134.91 feet to the Northeast <br />corner of Lot No.9 in "Charmil Estates"; run thence N 73°03'41" W along the <br />North line of said Lot No.9 a distance of 184.27 feet; run thence N 68°37'26" W <br />along the North side of Lot No. 8 in "Charmil Estates" a distance of 180.61 <br />feet to the East right-of-way line of State Highway 67; run thence N 10°52'34" E <br />a distance of 390.0 feet; thence run N 06°47'38" E a distance of 313.26 feet; <br />thence run N 87°47'23" E a distance of 1078.68 feet to the West line of the <br />Penn-Central Railroad; run thence S 00°03'53" W along said right-of-way a <br />distance of 1283.5 feet to an iron post; run thence S 87°10' W along the South <br />line of said Northwest quarter a distance of 458.0 feet to the beginning point, <br />containing 26.427 acres, more or less, SUBJECT to all easements. <br /> <br />WHEREAS, said Board of Trustees of the Civil Town of Mooresville, Indiana <br /> <br />have considered the petition and recommendation of the Mooresville Plan Commission, <br /> <br />it is now ordered and ordained that the above described real estate is now rezoned <br /> <br />from its present classification to a zoning classification of Agricultural Residential. <br /> <br />This ordinance passed this ~ day of June, 1983. <br /> <br />BOARD OF TRUSTEES, <br />CIVIL TOWN OF MOORESVILLE <br /> <br />
