ORDINANCE NO. iF/o -.---- 1983 SPECIAL ORDINANCE REZONING REAL ESTATE IN ________ ___~º!(GA~- s::()lJ~'l'X_'_lND I!,N A __po WHEREAS, the Mooresville Plan commission held a public hearing on July 28, 1983, with reference to a "Application for Rezoning" filed by Allen D. Tutewiler and Sue Ann Tutewiler which Petition was docketed as Plan Commission Docket No.3, 1983, ,iJ1d WHEREAS, the Mooresville Plan Commission having jurisdic- tion over the subject real estate has recommended to the Board of Trustees of the Town of Mooresville, Indiana that the Application for Rezoning as filed by said applicants be rezoned from its pr~scnt classification GB-General Business to I-Industrial, and WHEREAS, the Board of Trustees of the Town of Mooresville, Indiana now accepts the recommendation of the Mooresvil1e Plan Commission and the following real estate located within the jurisdic- tion of the Mooresvillc Plan Commission is hereby rezoned to zoning classification I-Industrial. Such real estate located in Morgan Cc)unty, State of Indiana is more particularly described as follows, to-wit: Part of the West half of the Southeast quarter and part of the East half of the Southwest quarter of Section 36, Township 14, North, Range 1, East of the Second Principal Meridian, Morgan County, Indiana bounded and described as follows, to-wit: Beginning at an iron pipe at the Southeast corner of the West half of the West half of the Southeast quarter of Section 36, Township and range aforesaid, run thence S 890 35' W on the South line of said Section 36 a distance of 5A9.89 feet to the Southeast corner of the fallowing described tract and the BEGINNING POINT of this descrigtion: From said beginning point continue thence S 89 35' W on the South line of said Section 36 a distance of 391.71 feet more or less, to an iron pipe on the East right-of-way line of the Penn-Central Rail- o road; from said point run thence N 02 57' 30" E on said right-of-way line a distance of 875.72 feet to the Southwest corner of a tract of land now belonging to Freeman Florist; run thence N 580 19' 30" E a di~tance of 294.53 feet to the Northwest corner of a ~:ract con- taining 0.958 of an acre; run thence S 310 40' 30" E a distance of 225.90 feet to the Center of a sewer manhole; o 5 ' run thence S 01 33' 1" W on the West 11ne of a tract containing 11.536 acres a distance of 834.43 feet to the be~inning point, containing 8.239 acres, more or less. -1-
