<br />I <br /> <br />AN AMENDMENT TO ORDINANCE NO. 18, 1979 <br />FLOOD DAMAGE PREVENTION ORDINANCE FOR <br />THE TOWN OF HOORESVlLLE, INDIANA <br />ORDINANCE NO. /:.. , 1982 <br /> <br />ARTICLE I. <br />AUTHORIZATION, FINDINGS, PURPOSE AND OBJECTIVES: <br /> <br />Section 1. Statutory Authority; The Legislature <br /> <br />of the State of Indiana has authorized the Board of Trustees <br /> <br />of the Town of Hooresville, Indiana, to adopt regulations <br /> <br />designed to promote public health, safety and general wel- <br /> <br />fare of its citizens pursuant to I.C. (1971) 18-7-S-l, in- <br /> <br />cluding the adoption of flood damage prevention ordinances. <br /> <br />Therefore, the Board of Trustees of Hooresville does ordain <br /> <br />as follows: <br /> <br />Section 2. Findings of Fact: <br /> <br />A. The flood hazard areas of the Town of <br /> <br />Mooresville are subject to periodic inudation which results <br /> <br />in loss of life and property, health and safety hazards, dis- <br /> <br />ruption of commerce and governmental services, extraordinary <br /> <br />public expenditure for flood protection and relief and impair- <br /> <br />ment of the tax base, all of which adversely affect the public <br /> <br />health, safety and general welfare. <br /> <br />B. These flood losses are caused by the <br /> <br />cumulative effect of obstructions in areas of special flood <br /> <br />hazards, which increase flood heights and velocities, and <br /> <br />which when inadequately anchored cause damage in other areas. <br /> <br />Uses that are inadequately flood proofed, elevated or other- <br /> <br />wise protected from flood damage also contribute to the flood <br /> <br />loss. <br /> <br />Section 3. Purpose: It is the general purpose of <br /> <br />this Ordinance to promote the public health, safety, and <br /> <br />general welfare, and to minimize public and private losses <br /> <br />due to flood conditions in specific ares by provisions de- <br /> <br />signed: <br /> <br />A.
