<br />r <br /> <br /> (1) No variance or exception for a <br />residential use ~a Floodway (F1N) District may be granted; <br /> (2) Any variance or exception granted <br /> <br />in a Floodway (F1N) District will require a permit from the <br /> <br />Indiana Department of Natural Resources; <br /> <br />(3) Variances or exceptions to the <br /> <br />flood protection grade requirements in a Floodway Fringe <br /> <br />(FF) District may be granted only when a new structure is <br /> <br />to be located on a lot of one-half acre or less in size, <br /> <br />contiguous to and surrounded by lots with existing struc- <br /> <br />tures constructed below the flood protection elevation; <br /> <br />(4) Any variance or exception in a <br /> <br />Flood Plain (FP) District will require a permit or letter of <br /> <br />recommendation from the Indiana Department of Natural Re- <br /> <br />sources. If a letter of recommendation is received from <br /> <br />the Department of Natural Resources, the Mooresville Board <br /> <br />of Zoning Appeals may apply the standards pertaining to a <br /> <br />Floodway Fringe (FF) District contained in (B) (3) of this <br /> <br />section; <br /> <br />C. Variances shall not be issued within <br /> <br />any designated floodway if any increase in flood levels <br /> <br />during the base flood discharge would result. <br /> <br />D. Variances shall only be issued upon <br /> <br />determination that the variance is the minimum necessary, <br /> <br />considering the flood hazard, to afford relief. <br /> <br />E. Any applicant to whom a variance is <br /> <br />granted shall be given notice that the structure will be <br /> <br />permitted to be built with the lowest floor elevation below <br /> <br />the base flood elevation and that the cost of flood insur- <br /> <br />ance will be dommensurate with the increased risk resulting <br /> <br />from the reduced lowest floor elevation. <br /> <br />ARTICLE VI. <br />PROVISIONS FOR FLOOD HAZARD REDUCTION: <br /> <br />Section 1.
