No mobile home shall be placed in <br /> <br />a floodway, except in an existing mobile home park or an <br /> <br />existing mobile home subdivision. <br /> <br />D. <br /> <br />Floodways: <br /> <br />Located within areas of <br /> <br />special flood hazard established in Article III., Section 2, <br /> <br />are areas designated as floodways. <br /> <br />Indiana Department of <br /> <br />Natural Resources exercises primary jurisdiction in the <br /> <br />Floodway District under the provisions of I.C. 1971, 13-2- <br /> <br />22, however, the Mooresville Plan Commission may impose <br /> <br />terms and conditions on any permit it issues in this dis- <br /> <br />trict which are more restrictive than those imposed by <br /> <br />Natural Resources. <br /> <br />Within this district the following pro- <br /> <br />visions shall apply: <br /> <br />1. No residential structures shall be <br /> <br />allowed, <br /> <br />2. Prohibit the placement of a mobile <br /> <br />home except in an established mobile <br /> <br />home park or mobile home subdivision; <br /> <br />3. Prohibit any construction, obstruc- <br /> <br />tion, excavation, or deposit of material <br /> <br />which will result in an increase of the <br /> <br />surface water elevation of more than a <br /> <br />tenth of a foot, <br /> <br />ARTICLE VII. <br /> <br />Section 1. <br /> <br />Non-Conforming Uses: <br /> <br />Any building, structure or other use in a Flood <br /> <br />Plain (FP), Floodway (FW) or Floodway Fringe (FF) District <br /> <br />which is not in conformance with this Ordinance constitutes <br /> <br />a non-conforming use. <br /> <br />-18- <br />
