} <br /> RESOLUTION 3 , 2013 <br /> BE IT HEREBY RESOLVED, that the Town Council is the <br /> governing body of the Town of Mooresville; <br /> WHEREAS, the Clerk/Treasurer' s Office is in charge of <br /> collecting payments for the use of any utility of the Town; <br /> WHEREAS, the Clerk/Treasurer' s Office does accept payments <br /> concerning utility user fees in the form of bank cards or credit <br /> card payments; <br /> WHEREAS, pursuant to IC 36-1-8-11 as of July 1, 2013 a <br /> municipally owned utility may contract with a bank card or <br /> credit card vendor for acceptance of bank card or credit card <br /> payments and charge a fee to the customer for this type of <br /> payment ; <br /> WHEREAS, an official fee may be charged for this <br /> transaction allowing the municipally owned utility to collect <br /> from the person using a card either or both of the following: <br /> an official fee that may not exceed the transaction charge or <br /> discount fee charged to the municipally owned utility or a <br /> reasonable convenience fee that may not exceed Three Dollars <br /> ($3 . 00) ; <br /> NOW THEREFORE BE IT RESOLVED that. the Town of Mooresville <br /> creates a convenience fee pursuant to Indiana Code in the amount <br /> of Three Dollars ($3 . 00) per payment by bank card or credit card <br />
