A.uditor, Morgan County <br /> <br />AMENDED <br />ORDINANCE NO. 4-1974 <br /> <br />AN ORDINANCE ANNEXING CERTAIN REAL ESTATE SITUATED <br />OUTSIDE THE CORPORATION BOUNDARIES OF THE TOWN OF MOORESVILLE, <br />BEING ADJACENT THERETO, AND DEFINING SAID TOWN BOUNDARIES AND <br />PROVIDING FOR THE PUBLICATION THEREOF. <br /> <br />WHEREAS, Morgan County Bank & Trust Company has previously <br /> <br />brought a Petition for Annexation for the herein-described real <br /> <br />estate on March 19, 1974, and subsequently has brought a pe- <br /> <br />tition jointly as Lessee with Morgan County Properties, Inc. as <br />fee simple owner of the herein-described real estate for the <br /> <br />annexation of the herein-described real estate; and <br /> <br />WHEREAS, the Mooresville Town Board has determined that <br /> <br />the annexation of the following described territory is in the <br /> <br />best interests of the Town of Mooresville and the territory <br /> <br />to be annexed; and <br /> <br />WHEREAS, the Mooresville Town Board has determined that <br /> <br />the area to be annexed is urban in character and is an economic <br /> <br />and social part of said Town; and <br /> <br />WHEREAS, the Mooresville Town Board has determined that <br /> <br />the Town of Mooresville is financially able to provide munici- <br /> <br />pal services to the area to be annexed within the reasonably <br /> <br />near future; and <br /> <br />WHEREAS, the Mooresville Town Board has determined that <br /> <br />the area sought to be annexed is needed for the development <br /> <br />of the Town of Mooresville in the reasonably near future; and <br /> <br />WHEREAS, the lines of annexation are so drawn as to form <br /> <br />a compact area abutting the municipality; and <br /> <br />WHEREAS, the proposed annexation should be made conditional <br /> <br />upon the area sought to be annexed being rezoned to a classifi- <br /> <br /> <br />cation of LB - Local Business under "Zoning Regulations of <br /> <br />Mooresville, Indiana, 1972"; <br /> <br />THEREFORE, BE IT ORDAINED BY THE TOWN BOARD OF MOORESVILLE <br /> <br />that the boundary of said Town be, and the same is hereby ex- <br />tended so as to include the contiguous territory within the £01- <br /> <br />lowing limits located in Morgan County, Indiana, to-wit: <br /> <br />Part of the Southwest quarter of the Northwest <br />Fractional Quarter of Section 31, Township 14 North, <br /> <br />1 <br />" .j <br />
