C <br /> <br />C <br /> <br />ORDINANCE ~ , 2 0 01 <br /> <br />AN ORDINANCE REZONING REAL PROPERTY WITHIN <br />THE CIVIL TOWN OF MOORESVILLE <br /> <br /> WHEREAS, a public hearing was held before the Mooresville Plan <br />Commission with all proper legal notice being given as required by <br />the Town of Mooresville Zoning Ordinance upon the Application for <br />Rezoning filed by Casey's General Stores, Inc. concerning the real <br />property described in the attached Exhibit UA# which is attached <br />hereto and made a part hereof requesting a rezoning from B-2 <br />Business to B-3 Business; <br /> <br /> WHEREAS, the Mooresville Plan Commission having reviewed the <br />Petition at a public hearing and approving the Petition subject to <br />the restriction that the only B-3 Use allowable would be the sale <br />of gasoline and related petroleum products pursuant to those uses <br />normally accompanying a gasoline station along with the requirement <br />that three (3) lanes of traffic be made available adjoining the use <br />to allow for an access lane to the business; <br /> <br /> WHEREAS, the Mooresville Town Council having reviewed the <br />Application and recommendation of the Mooresville Plan Commission <br />now finds that the rezoning Application should be approved subject <br />to the restrictions set out above; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED that the zoning classification <br /> of B-3 Business shall hereinafter apply to the real property <br /> described in the attached Exhibit ~A" subject to the restriction <br /> that the only allowable B-3 Use shall be the sale of petroleum <br /> products pursuant to the use as a gasoline station and that an <br /> additional lane be added as a third lane on this side of the road <br /> <br /> <br />
