Upon receipt, the Floodplain Administrator may issue the local Floodplain Development Permit, provided <br /> the provisions contained in Article 5 of this ordinance have been met. <br /> (3) The total cumulative effect of the proposed development, when combined with all other existing and <br /> anticipated development, will not increase the regulatory flood more than 0.14 of one foot and will not <br /> increase flood damages or potential flood damages. <br /> Section H. Standards for Flood Prone Areas. <br /> All development in known flood prone areas not identified on FEMA maps, or where no FEMA published map is <br /> available, shall meet applicable standards as required per Article 5. <br /> Article 6. Variance Procedures. <br /> Section A. Designation of Variance and Appeals Board. <br /> The Board of Zoning Appeals shall hear and decide appeals and requests for variances from requirements of this <br /> ordinance. <br /> Section B. Duties of Variance and Appeals Board. <br /> The board shall hear and decide appeals when it is alleged an error in any requirement, decision, or <br /> determination is made by the Floodplain Administrator in the enforcement or administration of this ordinance. Any <br /> person aggrieved by the decision of the board may appeal such decision to the Morgan County Circuit Court. <br /> Section C.Variance Procedures. <br /> In passing upon such applications, the board shall consider all technical evaluations, all relevant factors, all <br /> standards specified in other sections of this ordinance, and; <br /> (1) The danger of fife and property due to flooding or erosion damage. <br /> (2) The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage <br /> on the individual owner. <br /> (3) The importance of the services provided by the proposed facility to the community. <br /> (4) The necessity to the facility of a waterfront location, where applicable. <br /> (5) The availability of alternative locations for the proposed use which are not subject to flooding or erosion <br /> damage. <br /> (6) The compatibility of the proposed use with existing and anticipated development, <br /> (7) The relationship of the proposed use to the comprehensive plan and floodplain management program for <br /> that area. <br /> (8) The safety of access to the property in times of flood for ordinary and emergency vehicles. <br /> (9) The expected height, velocity, duration, rate of rise, and sediment of transport of the floodwaters at the <br /> site, <br /> Page 117 <br />
