MOORESVILLE BOARD OF ZONING APPEALS <br />FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br />Pursuant to IC 36-7-4-918.5, the Mooresville Board of Zoning <br />Appeals having heard the Variance filed by Mooresville Christian <br />Academy at the meeting held May 11, 2017, regarding the real <br />property located at 4271 E. SR 144, Mooresville, Indiana <br />requesting a variance from the requirement of a maximum of 30% of <br />total existing sign frame and pole to exceed 30%. The <br />measurements are based on one side; the lift logo is 25 sq. ft., <br />the digital portion within the frame is 34.44 sq. ft. and the <br />pole portion of the sign is 27 sq. ft. The aforementioned <br />dimensions shall create the new maximum percentage to be allowed <br />by this Variance. <br />1. The approval will not be injurious to the public <br />health, safety, morals and general welfare of the community since <br />this is located on a State highway, there will be restrictions on <br />dimming the light at 9:00 p.m. nightly along with the restriction <br />that the flashing mode of the digital sign is never to be used. <br />2. The use and value of the area adjacent to the property <br />included in the variance will not be affected in a substantially <br />adverse manner for the following reasons: this is on a State <br />highway and the existing school buffers the adjoining owner <br />sufficiently as not to adversely impact their value based upon the <br />signage. <br />3. The strict application of the terms of the Zoning <br />Ordinance will result in practical difficulties in the use of the <br />property, namely: it is located on a State Highway and the school <br />and B-1 use are already in effect, however, there will not a use <br />that is out of place to the area as a B-1 zoned property with <br />restricted other practical uses needed for the existing school. <br />Restrictions: <br />The signage will be dimmed at 9:00 p.m. nightly and the use of any <br />
