MOORESVILLE BOARD OF ZONING APPEALS <br />FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br />Pursuant to IC 36-7-4-918.5, the Mooresville Board of Zoning Appeals <br />having heard the Variance filed by Mooresville Christian Academy at the <br />meeting held May 11, 2017, regarding the real property located at 4271 E. SR <br />144, Mooresville, Indiana requesting a variance from the requirement the use <br />of an EMC sign within 300' of an R-1 zoning classification, now finds: <br />1. The approval will not be injurious to the public health, safety, <br />morals and general welfare of the community since this is located on a State <br />highway, there will be restrictions on dimming the light at 9:00 p.m. nightly <br />along with the restriction that the flashing mode of the digital sign is never <br />to be used. <br />2. The use and value of the area adjacent to the property included in <br />the variance will not be affected in a substantially adverse manner for the <br />following reasons: this is on a State highway and the existing school buffers <br />the adjoining owner sufficiently as not to adversely impact their value based <br />upon the signage. <br />3. The strict application of the terms of the Zoning Ordinance will <br />result in practical difficulties in the use of the property, namely: it is <br />located on a State Highway and the school and B-1 use are already in effect, <br />however, there will not a use that is out of place to the area as a B-1 zoned <br />property with restricted other practical uses needed for the existing school. <br />4. Also there are other similar uses in the area including Neil <br />Armstrong Elementary School, Good Sheppard Baptist Church and Westlane Church. <br />On the third one sign close to residential uses the restrictions on all the <br />same and then the restrictions begin the sign at 9:00 p.m. and barr the use of <br />any flashing mode in sign usage to adequately protect. <br />Restrictions: <br />The signage will be dimmed at 9:00 p.m. nightly and the use of any flashing <br />mode in the sign will be barred. <br />
