RESOLUTION NO. - 2019 <br />RESOLUTION REGARDING WAIVER OF <br />NONCOMPLIANCE FOR LAST MOVE, LLC <br />WHEREAS, the Town of Mooresville, Indiana (the "Town") has previously adopted its <br />Resolution 9-2019 (the "Resolution") approving a real property tax abatement for Last Move, <br />LLC ("Last Move"). <br />WHEREAS, Last Move (a) failed to submit the completed statement of benefits form to <br />the designating body (the "Town Council") before the initiation of the redevelopment or <br />rehabilitation of the subject real estate, and (b) failed to cause the Economic Revitalization Area <br />(as described in the Resolution) to be designated prior to the initiation of the redevelopment or <br />rehabilitation of the subject real estate, and consequently, has not received the real property tax <br />abatement which was approved in the Resolution. <br />WHEREAS, Last Move has asked the Town to waive Last Move's noncompliance with <br />Indiana Code 6-1.1-12.1-11.3. <br />WHEREAS, the Town desires to grant to Last Move a waiver of noncompliance upon the <br />terms and conditions described herein. <br />NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN <br />OF MOORESVILLE, INDIANA that: <br />SECTION 1. The Mooresville Town Council, after a public hearing held on the date <br />hereof, hereby waives noncompliance as described above by Last Move on the condition that <br />Last Move has certified that the improvements which are the subject of the real property tax <br />abatement were completed prior to the passage of the Resolution, and that such improvements <br />are located within the aforementioned Economic Revitalization Area. <br />SECTION 2. This Resolution shall be in full force and effect immediately upon its <br />passage and signing by the members of the Mooresville Town Council. <br />Passed and adopted by the Town Council of Mooresville, Indiana, on the 6th day of <br />August, 2019. <br />25457821.1 <br />
