Violations mar also be treated the same as any other <br />violation of this zon~ng ordinance and can be enforced by any <br />other provision set out under this ordinance at the <br />discretion of the Plan Commission. <br /> <br />SECTION 3-8 <br />OUTLINE OF PROPOSED BUFFER REQUIREMENTS <br /> <br />I. DEFINITION <br /> <br />A buffer is any physical ba~~ier, whether naturally occurring <br />or man-made, that has the year-round effect of protecting one <br />land use by mitigating the potentially negative effects of <br />another. <br /> <br />A protected use is any land use which needs to be protected <br />from potentially negative effects of another use. <br /> <br />An intruding use is any land use which needs to provide <br />buffering to mitigate potentially negative effects it may <br />have on anothe~ use. <br /> <br />II. REASONS FOR BUFFERS <br /> <br />Buffers are re9uired between protected and intruding land <br />uses that are ~ncompatible due to: <br /> <br />1. visual appearance, <br />2. noise level, <br />3. odor and <br />4. public health and safety, <br />5. density. <br /> <br />Minimum buffering requirements in terms of distance are <br />described on the following chart. These distances shall be <br />applied to all incompatible adjacent land uses as noted. <br /> <br />III. SPECIAL EXCEPTIONS <br /> <br />In applying the requirements of the chart, attention should <br />be focused on the actual use in a proposed zone if the use <br />involves a special exception. Appropriate bufferin~ should <br />be determined by the requirements of the zone in wh~ch the <br />special exception use would normally be located. As shown in <br />the chart on Page 64. <br /> <br />IV. EFFECTIVENESS OF BUFFERS <br /> <br />The goal of these buffering requirements is to describe the <br />minimum buffering required to protect one use from the <br />potentially negative effects of an intruding use.
