<br />SECTION 3.10 <br /> <br />EROSION CONTROL <br /> <br />------------------------------ <br /> <br />(a) <br /> <br />The Developers, lot owners, and permit holders of any <br />lot shall be responsible for erosion control during any <br />construction phase or development state of the lot. The <br />Developer, permit holder, and lot owner shall be each <br />jointly and severally responsible for keeping soil, <br />construction and other erosion debris off of the streets <br />of Mooresville or to Morgan County. The Developer, <br />permit holder, and lot owner shall be each jointly and <br />severally responsible for keeping soil and other <br />construction debris and other erosion debris out of <br />storm sewers shown on the plat or storm sewers which are <br />owned by or dedicated to the Town of Mooresville or <br />Morgan County. In the event the Town of Mooresville or <br />Morgan County is damaged by soil erosion on their right <br />of way, street, drainage easement, or in their storm <br />sewer, they shall have the option of having the debris <br />removed and charge anyone or all of the following: lot <br />owner, builder, or developer, for this expense. The <br />Town of Mooresville or Morgan County shall also have the <br />option of giving the developer, permit holder, or lot <br />holder a written notice to have the debris removed <br />within twenty-four hours. In the event the debris is <br />not removed within twenty-four hours. In the event the <br />debris is not removed within twenty-four hours they <br />shall be cited into the Mooresville Town Court by a <br />civil summons issued by the Town Building Inspector as <br />being in violation of this ordinance. In the event the <br />Town of Mooresville does remove the debris and passes <br />the charge on to the lot owner, builder, or Developer <br />for the removal expense and the expense is not paid <br />within thirty days then they shall be cited into the <br />Mooresville Town Court as being in violation of this <br />ordinance. Any Developer, owner, or permit holder found <br />in violation of this ordinance shall be fined in an <br />amount of not less than $1.00 nor greater than $500.00 <br />for a violation of the ordinance along with being <br />assessed all costs for the clean up of the street or <br />storm sewer and any additional damage created by said <br />violation shall be passed on to the violating party to <br />hold harmless both the Town of Mooresville and Morgan <br />County for all damages created by the violation of this <br />ordinance. <br /> <br />(b) <br /> <br />All developers shall be required to show the plan <br />commission compliance with the State of Indiana's local <br />erosion control commonly known as Rule 5 by showing <br />copies of the plan filed with the State and certifying <br />the date of the filing. This shall be done prior to <br />final plat approval. <br /> <br />63 <br />
