MOORESVILLE BOARD OF ZONING APPEALS
FINDINGS OF FACT
FOR VARIANCE FROM DEVELOPMENT STANDARDS

Pursuant to IC 36-7-4-918.5 the Mooresville Board of Zoning Appeals having heard
the variance filed by R J Associates (Ashbury Park) requesting a variance from development
standards as follows: lot size from 7,000 square feet to 5,300 square feet; the Board now
makes the following Finding of Fact pursuant to IC 36-7-4-918.5:

1. The approval will not be injurious to the public health, safety, morals, and general
welfare of the community for the following reasons: it is compatible with the existing Park.

2. The use and value of the area adjacent to the property included in the variance
will not be affected in a substantially adverse manner; for the reasons that: it is compatible
with the existing Park.

3. The strict application of the terms of the Zoning Ordinance will result in practical
difficulties in the usc of the property. However, the Zoning Ordinance may establish a
stricter standard than the "practical difficulties" standard prescribed by this subdivision. The
actual practical difficulties found to exist here are as follows: to make it similar to the
existing park this would have to be reduced.

Stipulations to run with variance

None

APPROVED four to one.

Alan Kramer

Michael Young
