MINUTES <br /> TItURSDAY, APRIL 11, 2002 <br /> <br />The Board of Zoning Appeals met on Thursday, April 11, 2002 at 7:30 P.M. at the <br />Mooresville Town Hall. <br /> <br />The members present were: Alan Kramer, Chairman, Jon Swisher, Mike Young, Don <br />Barry, and Chris Crouch. Town Attorney, Tim Currens, was present. <br /> <br />Motion was made by Don Barry, second by Mike Young to approve the minutes of the <br />March 14, 2002 meeting. Motion carried 5-0. <br /> <br />Next on the agenda was Ross Holloway of Holloway & Associates, represenfng Mr. Jack <br />Ward, requesting a Special Exception to allow automobile sales and associated uses in B- <br />3 zoned district. Mr. Holloway stated they had tho property rezoned from B-2 to B-3 a <br />few months ago; the Town Council approved the rezone m March. This Board sent the <br />Special Exception to the Plan Commission for recommendation on it's effect of the <br />Master Plan, the Commission stated they found no ill effecl of the Master Plan and was <br />not a hindrance, so they sent if back to the Board of Zoning for their approval. They <br />previously turned m their illegal notices and green cards and Mr. Holloway was here to <br />answer any question the board might have. They do not believe there will be any <br />hindrance to property value, it will not be a health or welfare issue, there should not be <br />any adverse effect on traffic, or other infrastructures. Mr. Currens stated for the record <br />that the public hearing for the last meeting was continued with the advice thai anyone <br />present no new notices would be sent out and as he recalls there was no one present. Mr. <br />Holloway pointed out that there have been car sales on Indiana Slteet for several years. <br />Mr. Young said he had talked with Mr. Ward about the'number of cars they would have <br />on the lot at one time. Mr. Ward indicated that he would only have about three (3) cars at <br />a time. Mr. Young recommended that a limit of six (6) cars be set for the Special <br />Exception. Mr. Holloway said Mr. Ward would agree to a limitation of six (6) to eight <br />(8) cars being set. Mr. Crouch asked if the Special Exception went with the sale of the <br />property and Mr. Currens said that it did. <br /> <br /> Mr. Kramer said if there were no further question he would read the Facts of Findings: <br /> <br /> 1. The establishment or operation of a Special Exception will not be detrimental <br /> to or endanger the public health, safety, morals or general welfare. No <br /> problem. <br /> 2. The Special Exception will not be injurious to the use and enjoyment of the <br /> other properties in the immediate vicinity for the purposes already permitted. <br /> No problem. <br /> 3. The establishment of the Special Exception will not impede or substantially <br /> alter the orderly development and improvement of the surrounding property <br /> for such use as permitted in this district. No problem. <br /> <br /> <br />
