SEPTEMBER 12, 2002, 7:00 P. M.

The MooreSville Board of Zoning Appeals met on Thursday, September 12, 2002, at 7:00
PM at the Mooresville Town Hall.

Board members present: Chris Crouch, Don Barry, Mike Young, Jon Swisher, Alan
Kramer appeared after the motion to approve the minutes. No members were absent.
Town attorney Tim Currens was present.

Motion was made by Don Barry, second by Mike Young to approve the minutes of the
August 8, 2002 meeting. Motion carded 4-0.

First on the agenda was Mildred and John Curtis requesting a variance for a mobile home
on their property at 3127 North Western Road due to a medical hardship. Tim Currens
told them that under our ordinance we did not have a hardship clause. The county used to
have such an ordinance. Mrs. Curtis wants to move her mother into a modular home on
their five acres. Tim Currens told them they. would need to make a decision to request a
minor plat or a variance for more than one residence on a single piece of property. In
other words the variance they had filed was not filed correctly. They need to specify
manufactured home also. The home is 1400 square feet. If they decide to go for a minor
plat, they would need to file for plan commission and send new notices. If they decide to
go for the variance .they need to re-file and send new notices.
Next on the agenda was Ross Holloway of Holloway and Associates with a letter of
request for a referral to the Plan Commission in relation to 4.08 acres located at the
northwest quadrant of Highway 144 and Highway 67. Mr. Herb Haggard and Mr. James
Remster will be requesting a special exception to a B-3 zoning (the rezone will have to go
thru the Plan Commission and the Town Council. Proposed use for this property is auto
sales and/or mini warehouses.
Town attorney Tim Currens stated there would be no.problem to proceed in this manner.
This item will be on the agenda for the September 26~Plan Commission meeting.
The board signed Findings of Fact from the August 8, 2002 meeting. The special
exception request for mini-warehouses at 269 North Monroe Street on property owned by
Wayne Pace was denied at that meeting.

There being no further'business to come before the Board of Zoning Appeals, a motion
was made by MikeYoung, second by Don Barry to adjourn the meeting. Motion carried
5-0
The next meeting of the Mooresville Board of Zoning Appeals will be Thursday, October
10, 2002 at 7:00 PM at the Mooresville Town Hall.
