MOORESVILLE BOARD OF ~ONIN~ ~PPE/~LS <br /> FINDINGS OF F~CT <br /> <br /> Comes now Springhill Christian Ministries and petitions the <br />Mooresville Board of Zoning Appeals for a Variance from use <br />standards requesting a school in an R-1 zoning. The Board of <br />Zoning Appeals having found notices to be in order and having held <br />a public hearing on the 19th day of January, 1994 now makes the <br />following findings pursuant to I.C. 36-7-4-918.4: <br /> <br /> 1. That the approval of the variance will not be injurious to <br />the public health, safety, morals, and general welfare of the <br />community due to the location of the school, adjoining church, and <br />corner lot. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner due to the church structures and other <br />similar uses. <br /> <br /> 3. That the need for the variance arises from some condition <br /> <br />peculiar to the property involved, <br />for church purposes including the <br />other appurtenant uses. <br /> <br />namely the use of the property <br />gymnasium, church building and <br /> <br /> 4. That the strict application of the terms of the zoning <br />ordinance will constitutes an unnecessary hardship if applied to <br />the property for which the variance is sought in that a rezoning <br />for all of the property would be inappropriate yet this use is <br />consistent with the existing use. <br /> <br /> 5. The approval does not interfere substantially with the <br />comprehensive plan adopted under the 500 series of this chapter. <br /> <br /> <br />
