MOORESVILLE BOARD OF ~ONIN~ ~PPE/~LS
FINDINGS OF F~CT

Comes now Springhill Christian Ministries and petitions the
Mooresville Board of Zoning Appeals for a Variance from use
standards requesting a school in an R-1 zoning. The Board of
Zoning Appeals having found notices to be in order and having held
a public hearing on the 19th day of January, 1994 now makes the
following findings pursuant to I.C. 36-7-4-918.4:

1. That the approval of the variance will not be injurious to
the public health, safety, morals, and general welfare of the
community due to the location of the school, adjoining church, and
corner lot.

2. That the use and value of the area adjacent to the
property included in the variance will not be affected in a
substantially adverse manner due to the church structures and other
similar uses.

3. That the need for the variance arises from some condition

peculiar to the property involved,
for church purposes including the
other appurtenant uses.

namely the use of the property
gymnasium, church building and

4. That the strict application of the terms of the zoning
ordinance will constitutes an unnecessary hardship if applied to
the property for which the variance is sought in that a rezoning
for all of the property would be inappropriate yet this use is
consistent with the existing use.

5. The approval does not interfere substantially with the
comprehensive plan adopted under the 500 series of this chapter.
