MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the <br />variance request filed by Harold and Jane Lloyd residing at 1062 <br />Keller Hill Road, Mooresville, Indiana requesting a variance for a <br />second dwelling on their real property for a family member. The <br />Mooresville Board of Zoning Appeals having reviewed the petition <br /> <br />of Harold and Jane Lloyd at a public <br />August, 7993 now makes the following <br /> <br />I.C. 36-7-4-918.4: <br /> <br />hearing held the 18th day of <br />findings of fact pursuant to <br /> <br /> 1. That the approval of the variance will not be injurious <br />to the public health, safety, morals, and general welfare of the <br />community due to the size of the Lloyd's lot and the nature of the <br />variance being requested. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in any <br />substantially adverse manner due to the nature of the <br />improvement which already is in existence. <br /> <br /> 3. That the need for a variance arises from some condition <br />peculiar to the property involved which includes the size and <br />shape of the lot. <br /> <br /> 4. That the strict application of the terms of the zoning <br />ordinance will constitute an unnecessary hardship if applied to <br />the property for which the variance is sought due to the size and <br />shape of the property. <br /> <br /> 5. That the approval does not interfere substantially with <br />the comprehensive plan adopted under the 500 series of this <br />chapter due to the nature of the variance requested being a <br />residential use. <br /> <br /> The Mooresville Board of Zoning Appeals now grants this <br />variance from use under the Mooresville Zoning Ordinance subject <br />to the following restrictions: <br /> <br /> That this use shall be allowed in the area above the <br /> garage for a residential dwelling for immediate family members <br /> only and shall never be rented nor used for residential purposes <br /> <br /> <br />
