MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the <br />variance request filed by Missions Alive, Inc. on the real <br />property located at 1980 S.R. 144, Mooresville, Indiana requesting <br />a variance from use to allow the operation of a religious <br />missionary video tape production studio on the real property which <br />is currently classified for zoning purposes as agricultural, and <br />the Board having heard evidence at a public hearing now makes the <br />following findings of fact pursuant to I.C. 36-7-4-918.4: <br /> <br /> 1. That the approval of the variance would not be injurious <br />to the public health, safety, morals, and general welfare of the <br />community due to the nature of the use being low traffic and the <br />type of use being one that is not visible. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner due to the type of use and the low <br />visibility of the use and the size of the lots in this <br />agricultural area. <br /> <br /> 3. That the need for the variance arises from some <br />condition peculiar to the property involved, namely the size and <br />shape of the lot with the back outbuildings behind the current <br />residential use. <br /> <br /> 4. That the strict application of the terms of the zoning <br />ordinance will constitute an unnecessary hardship if applied to <br />the property for which the variance is sought in that the back <br />portion of the property is not conducive for farming or any other <br />use. <br /> <br /> 5. That the approval does not interfere substantially with <br /> the comprehensive plan adopted under the five hundred series of <br /> <br /> <br />
