MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board <br />variance request <br />Siebenmorgen of <br />variance from 20 <br /> <br /> of Zoning Appeals having reviewed the <br /> <br /> filed by Todd I. Siebenmorgen and Kimberly E. <br />363 Allen Drive, requesting a rear setback <br /> <br /> feet to 14 feet and a side variance setback <br /> <br />requirement from 10 feet to 6 feet to construct a garage, the <br />Board now makes the following findings of fact pursuant to I.C. <br />36-7-4-9~8.5: <br /> <br /> 1. That the approval of the variance will not be injurious to <br />the public health, safety, morals, and general welfare of the <br />community due to the fact that the use and construction is <br />compatible with adjoining properties. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner due to the value of the improvement <br />being added and the access being improved. <br /> <br /> 3.
