MOORESVlLLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals <br />variance request filed by Donald T. Fischer, <br />Street, requesting a Variance from the side <br /> <br /> having reviewed the <br /> <br />124 N. Indiana <br />setback from 10 feet <br /> <br />to 7 feet four inches, the board now makes the following findings <br />of fact pursuant to I.C. 36-7-4-918.5: <br /> <br /> 1. That the approval of the variance will not be injurious <br />to the public health, safety, morals, and general welfare of the <br />community due to the fact that the property adjoins an apartment <br />complex with a privacy fence. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner due to the compatible uses and <br />geography of the ground. <br /> <br /> 3. That the strict application of the terms of the zoning <br /> ordinance would result in practical difficulties in the use of the <br /> property as a B-] classification in that it could not comply with <br /> the Americans With Disabilities Act. <br /> <br /> This variance approved the 21st day of July, 1993. <br /> <br />MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />Date: <br /> <br /> <br />
