MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> FINDINGS OF FACT <br /> <br />The Mooresville Board of Zoning Appeals reviewed the variance <br /> <br />filed by Caperton Development Group on Crafton Meadows requesting <br /> <br />a variance from the width the depth ratios in Section Two on Lots <br /> <br />34, 35, 36,40, 41, 42, and Section Three Lots number 98, 99, and <br /> <br />100 and proceeded to a review of said variance requests at public <br /> <br />hearing. <br /> <br />The Board now makes the following findings of fact pursuant <br /> <br />to I.C. 636-7-4-918.5: <br /> <br />That the approval of the variance will not be <br />injuries to the public health, safety, morals and <br />general welfare of the community due to the fact <br />that the width to depth variance is based upon need <br />created by drainage. <br /> <br />That the use and value of the area adjacent to the <br />property included in the variance will not be <br />affected in a substantially adverse manner due to <br />a portion of the property being placed under water <br />for drainage purposes. <br /> <br />That the strict application of the terms of the <br />zoning ordnance would result in practical <br />difficulties in the use of the property more <br />particularly leaving ground without ownership in the <br />the drainage area. <br /> <br /> MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> St~ve Oschman, Chairman <br /> <br />Alan K-r~nmmar, Secretary <br /> <br /> <br />
