MOORESVILLE BOARD OF ZONING APPEALS

FINDINGS OF FACT

Mooresville Board of Zoning Appeals having reviewed the

variance from development standards request filed by Michael

Wilcher to allow a manufactured home with 780 square feet to

remain on the real property at 2262 Hadley Road as opposed to the

ordinance standard of 940 square feet; the Board of Zoning Appeals

now makes the following findings of fact pursuant to I.C. 36-7-4-

918.5:

1. That the approval of the variance will not be injurious
to the public health, safety, morals, and general welfare of
the community due to the fact that this use has been there
for over one year under the county's zoning ordinance and
meets the other ordinance requirements for manufactured
housing.

2. That the use and value of the area adjacent to the
property included in the variance will not be affected in a
substantially adverse manner due to the fact that this home
has been there for over a year and there is sufficient lot
size.

3. That the strict application of the terms of the zoning
ordinance would result in practical difficulties in the use
of the property, more particularly, the home was placed on
the property under the county ordinance and removal of the
home at this point in time would be unfair.

Do~ Barr-y,~''~-~ S~cretary

/

MOORESVILLE BOARD OF ZONING APPEALS

Alan Kramer, Chairman
