MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> FINDINGS OF FACT <br /> <br />The Mooresville Board of Zoning Appeals having reviewed the <br /> <br />variance request of James R. Honeycutt for a manufactured home <br /> <br />having less than 940 square feet, namely, 720 square feet and also <br /> <br />to allow for the construction of a home on the real property <br /> <br />located at 1900 Hadley Road containing approximately 43.339 acres <br /> <br />and two allow them to reside in the manufactured housing until <br />completion of the ~_ ~ home at which time the home will be <br /> <br />removed within thirty (30) days from the completion of a primary <br /> <br />structure so the area will not be in violation of two primary <br /> <br />structures on the same tract of ground; and the Board of Zoning <br /> <br />Appeals now makes the following findings of fact pursuant to I.C. <br /> <br />36-7-4-918.5: <br /> <br /> 1. That the approval of this variance would not be injurious <br />to the public health, safety, morals, and general welfare of the <br />community due to the location of the manufactured home being an <br />existing one which came in under the county's ordinance when the <br />Town's buffer zone was extended and that the other health and <br />safety requirements under the Town's ordinance have been met. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner in that this use was approved by the <br />county under their ordinance and has been continuing in excess of <br />a year at its present location and would cease in the event an <br />additional home is built. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of <br />this property, more particularly, that the removal of the home <br />which was approved by the county would be unfair. <br /> <br />MOORESVILLE BOARD OF ZONING APPEALS <br />Alan Kramer, Chairm~n <br /> <br /> <br />
