MINUTES OF THE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met for its regular meeting <br /> <br />on May 15, 1991 at 7:00 P.M. at the Mooresville Town Hall. <br /> <br /> Board members present were Alan Kramer, Vern Kimmel, Don Barry and <br />Charles McGuire. Absent was member Steve Oschman. Also present was the <br />Board's attorney, Timothy C. Currens. <br /> <br /> Alan Kramer said that the minute§ would be discussed under Old <br />Business. <br /> <br /> NEW BUSINESS <br /> <br /> Richard Woods, attorney, came before the Board representing Robert D. <br />and Mary A. Bingham, 124 East High Street. This is currently Big A Auto <br />Parts and a car wash. They wish to attach a 40' x 60' building to the <br />car wash for a wrecker repair business. This is zoned I2 so the setback <br />requirement is 10' and they are requesting a variance for a 5' setback. <br /> <br /> Alan K~amer felt it would be less than 5' and there should be a staked <br /> survey for accuracy. Tim Currens said this Board should act on accordingly. <br /> <br /> Don Barry made a motion to approve a 5' setback on the east property <br /> line. Vern Kimmel made a second. Motion carried unanimously. <br /> <br /> James R. Honeycutt came before the Board requesting a variance from <br /> 940 sq. ft to 720 sq. ft and to have more than one primary structure on <br /> the property. They wish to live in a mobile home which is under regulation <br /> while they are building their home. Tim Currens advised that the rules <br /> changed when this area was brought into the buffer zone and that we do not <br /> have a temporary permit but a permanent situation. Therefore, the Board <br /> does not have the authority to say a temporary structure must be removed <br /> after the permanent structure is build. <br /> <br /> Alan then asked for discussion from the floor. Jerry Lussing asked <br /> the Board if they could have their existing trailer and then place another <br /> trailer that met all the requirements on this property because if so, this <br /> would make a big difference. He was told this is possible. <br /> <br /> Phyllis Bagwell then asked if it must be on a permanent foundation and <br /> Tim answered yes but this was~granted by the county previously and Tim wants <br /> to check to see if this was grandfathered. Mrs. Bagwell then asked the age <br /> of the existing mobile home and was told it is a 1976 Coachmen. <br /> <br /> Mr. Lussing asked if there was a time frame placed on the variance and <br /> Tim replied that the county had experienced this problem in the past; there- <br /> fore, that is why we do not get into a temporary situation. <br /> <br /> <br />
