MOORESVILLE BOARD OF ZONING APPF_ALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />concerning the request for a variance by Robert D. Bingham and <br />Mary A. Bingham, RR #2, Box 102, Monrovia, Indiana, on May ~5, <br />1991, and having reviewed the request for a variance from the <br />development standards at 124 East High Street, to reduce the side <br />set-back to five feet now finds the following: <br /> <br /> 1. That the approval of this variance would not be injurious <br />to the public health, safety, morals and general welfare of the <br />community since it adjoins a railroad crossing. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner, again, since it adjoins a railroad <br />right-of-way. <br /> <br /> 3.
