411 <br /> MOORESVILLE PLAN COMMISSION <br /> MINUTES <br /> THURSDAY AUGUST 28, 2008 <br /> The Mooresville Plan Commission met in regular session on Thursday, August 28, 2008 <br /> at 6:p. m. at the, Mooresville Government Center. <br /> Members present were Chairman Mike Young, Commissioners: Darrell Brown, Robert <br /> Williamson, Perry King, James Logan, Charles Berwick, Ann Whaley and Brian <br /> Anderson. Also present was Town Attorney Tim Currens. <br /> Chairman Young asked for corrections or changes on the July 24, 2008, with no <br /> questions a motion from Commissioner King and a second from Commissioner Berwick <br /> was put before the Commission the motion passed 8-0 with none opposed. <br /> Monty Russell for R. K. Enterprises came before the Commission after being tabled in <br /> July. Mr. Russell asked to withdraw the Plat amendments and setbacks at this time. A <br /> • motion to accept Mr. Russell's request to withdraw came from Commissioner Logan <br /> seconded by Commissioner Berwick. The motion was 8-0 to accept the motion. <br /> Barry Todd of 11820 Civic Circle came asking to correct a statement that he had made at <br /> a previous meeting(6-26-2008),he had stated, that on June 19, 2008 at a home owners <br /> meetings that there was a unanimous vote for the changes that was proposed by Mr. <br /> Russell when he should have said a majority, the vote was 14-7 from the 21 people <br /> attending. <br /> Commissioner Williamson speaking to Mr. Russell said that in the June meeting that he <br /> referring to Mr. Russell had said that if the plat did not get changed that you could go <br /> ahead with your design and would pave back there and it would cause further run off. <br /> Commissioner Williamson said that by now that he understood that it would be an illegal <br /> act to cause any further run off. Mr. Russell responded by saying"as I stipulated I will <br /> stay with in the guidelines of"93 with the plat the way it was designed in '93." <br /> Commissioner Williamson ask Mr. Beikman if it is a new building project does the water <br /> flow of today apply? Mr. Beikman's reply was; if he adds any more impervious surface <br /> then the original plat, he would, need to refile everything again. Mr. Russell then said <br /> they would be between 80 and 82 percent of what was proposed in '93. <br /> The next item on the agenda was Stanley Butrum and the Carter Lee dust and noise <br /> control returning from past meetings.
