MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> FINDINGS OF FACT <br /> <br />RE: <br /> <br />Variance from development standards on the request of <br />Caperton Development Group on Roberson Woods Subdivision <br />and Roberson Village, pursuant to Indiana Code 36-7-4- <br />918.5: <br /> <br />I. As to the request in Roberson Village to reduce minimum size <br /> <br />of lots in R2 from 10,000 square feet to 8,400 square feet and to <br /> <br />reduce front set-back lines from 40 feet to 30 feet and reduce <br /> <br />minimum side yard set-back lines from 10 feet to 6 feet. <br /> <br />1. That the approval will not be injurious to the public <br />health, safety, morals, and general welfare of the <br />community: The Board finding that the reduced lines are <br />consistent with the type of homes to be constructed on the <br />property that will make this a compatible buffer to the <br />adjoining uses while still being consistent with the <br />necessary standards for public health, safety, morals, and <br />general welfare. <br /> <br />2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner; namely, that this use buffering <br />the commercial use and other residential uses will be quite <br />compatible and better than the previously proposed R3 use. <br /> <br />3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use <br />of the property due to the size of residential uses that can <br />be placed next to the commercial use. <br /> <br />II. Variance from development standards from city sidewalks of 5 <br /> <br />feet to 4 feet in Roberson Woods, Lot 5 and 6, 12 and 13, and ~8 <br /> <br />through 39, inclusively, and Lots 1 through 30 of Roberson <br /> <br />Village, reducing the development of the walks to a five foot <br /> <br />grassy area adjoined by a four foot walk: <br /> <br />1. The Board finds the approval will not be injurious to the <br />public health, safety, morals, and general welfare of the <br />community due to the amount of traffic in this subdivision <br />being compatible with the four foot walks. <br /> <br /> <br />
