?~: <br />January 17, 2006 <br />The Mooresville Town Council met in regular session on Tuesday, January l7, 2006, at <br />6:30 P. M. at the Mooresville Town Hall.. , <br />Council members present were: President Tom Worthen, Tray Bryant, John L: Clark, <br />and Toby Dolen. Eric Shields was absent. Town attorney Tim Currens was also present. <br />A motion was made by Councilman Dalen with a second by Councilman Clark tp <br />approve the minutes of January 3, 2006. Motion carried 4-0. <br />First item on the agenda was a discussion about increasing building permit fees and filing <br />fees for Board of Zoning Appeals and Plan Commission. The proposed fee increase is. <br />attached. The consensus on a PUD was since it allows more flexibility the filer would <br />probably be willing to pay more for this ability. Council President Tam Worthen wanted <br />to xnake the FUD fee $1,000 instead of $600 plus $40 per acre. Also discussed was <br />making a rezone $300 plus $40 per acre. A Subdivision plat would be filed for a rezone , <br />first at $300 plus $40 an acre, then file for a preliminary plat approval and then a fmal <br />plat approval fee. The PUD fee would include rezoning and plat approval at $1,000 plus <br />$40 per acre. A Special Exception goes to the Plan Commission first to make a fmding it <br />is compatible with the Master Plan and then it goes to the Board of Zoning Appeals to be <br />granted if it is compatible. This fee would be $500. Attorney Tim Currens told the <br />council they needed to make the fees not a money maker but to cover expenses incurred. <br />Council President Worthen wanted the ordinance to say the intent of the Mooresville <br />Town Council was to review the ordinance every. two years. A motion was made by <br />Councilman Dalen with a second by Councilman Bryant to approve the new fees with the ,, <br />changes made. Motion carried 3-1 with Councilman Clark opposed. <br />A motion was made by Councilman Clark with a second by Councilman Bryant to <br />approve computer year-end transfers of appropriation to appropriation in the same <br />department to get the appropriations in the black. Motion carried 4-0. <br />Two quotes were received for carpet for the New Town Hall. <br />Floors 2 You $22,857.14 <br />Marion Adams Floor Covering $25,398.00 <br />A motion was made by Councilman Bryant to with a second by Councilman Clark to <br />accept the lowest quote. Motion carried 4-0. <br />Legal: A motion was made by Councilman Clark with a second by Councilman Dolen to <br />approve a Refund Developer Availability agreement with Neer Development in the <br />amount of $26, 573.00. This would extend the wastewater line from the entrance to <br />Bridgemvre east to Landersdale Road. <br />Charles McGuire was appointed as a member from the Plan Commission to the Board of <br />Zoning Appeals for a four year term. This was an Executive appointment. <br />A motion was made by Councilman Dolen with a second by Councilman Clark to appoint <br />Greg Swinney from Industry and Joel Beebe a taxpayer to the Common Construction <br />Wage Committee. Motion carried 4-0. <br />Attorney Currens reported to the council on Ross Holloway's survey down by the Street <br />_ Garage. All,of Miler's deeds are based on a location line by Delbert Hobson done years <br />ago, The Town's location line was received from Testerman when the Town bought that <br />property. The Town had easements obtained for right-af way on the road already from <br />Millers and documents drawn on the Street Garage and'surrounding Tawn property. The <br />Town has signed an the easement but have no legal descriptions. Attorney Currens wants <br />to get more clarification on this and have the owner of other pazcel sign off on the <br />drainage easement. <br />Police Commissioner, Dennis Knierim, reported the new police cazs are in and they hope <br />to have the old cazs to auction soon: <br />
