~~~. <br />January 4, 2005 <br />The Mooresville Town Council met in regular session on Tuesday, January 4, 2005, at <br />6:30 P. M., at the Mooresville Town Hall. <br />Council members present were: Tom Worthen, Troy Bryant, John L. Clark, Toby Dolen, <br />and Eric Shields. Town attorney Tim Currens was present. <br />A motion was made by Councilman Shields with a second by Councilman Clark to <br />approve the minutes of December 21, 2004 meeting. Motion carried 5-0. <br />A motion was made by Councilman Dalen with a second by Councilman Clark to <br />nominate Tom Worthen for Council President. Motion carried 4-0. <br />Ross Holloway of Holloway Engineering presented a rezone far property located in the <br />triangle between Old St. Rd. 67 and New 67 at the north entrance to Town far E & F <br />Realty. The rezone is from Agriculture to a PUD-E. This project will include <br />condominiums for independent living; assisted living that includes an Alzheimer's unit, <br />and a nursing home. American Senior Communities LLC is the developer. There are 25 <br />net usable acres, the streets will be 22 feet wide, buildings are four to a unit, all brick to <br />the eve, variation in roof color, 1500 square feet of living space, and two car garages For <br />the independent living condos. The commercial area big blocks would have to came <br />back to the Plan Commission for site Plan Approval for turn lanes and landscaping buffer <br />between 67 and the independent units and around the perimeter. For the assisted living <br />there would be one seven-plea building with one community room and the rest are four- <br />plex with a one-car garage. The assisted living has call buttons to the main building for <br />help. The Plan Commission vote was 6-1 with Williamson opposed. Three out of the <br />four units have to be sold before the building can be built. Cost per unit is $140,000 per <br />unit. The earth retail entrance is 800-900 feet from the two 67 intersections. <br />Councilman Bryant wants them to find a way to put some turn lanes in and wants them <br />attached to the PUDE now. Part of the property is on the other side of Old 67 before the <br />railroad tracks and will be annexed into the Town also. This would allow the Town to <br />control the speed limit down Old 67. Annexation and sanitary lines are requested. The <br />project would employ between 100 to 120 people. Commissioner Bryant wants all three <br />entrances to have a turn lane. Mr. Holloway will show tapered blisters on the plat. <br />Commissioner Bryant brought up the fact the assisted living had no brick on the backs of <br />the units and he felt people would see too much vinyl at the entrance into Mooresville. <br />Mr. Holloway thinks there will be significant amount of landscaping to hide most of the <br />vinyl. There are sunroom on the back plus there would be 4 to S foot mounding <br />everywhere with. pine trees. The rent is $1200 to $1300 per assisted living unit. <br />President Worthen asked are we taking a step backwards with all the vinyl? How about <br />giving up some pine trees and put 50 percent brick an the back of the buildings. As an <br />extra-added comment, Mr. Holloway said that Marleywood Subdivision supported the <br />project. A motion was made by Councilman Clark with a second by Councilman Shields <br />to approve the rezone and put passing blisters on the drawings attached to the PUDE. <br />Motion carried 5-0. A motion was made by Councilman Clark with a second by <br />Councilman Shields to approve Ordinance #1, 2005 rezoning the property from <br />Agriculture to PUDE. Motion carried 5-0. <br />Attorney Phil Smith appeared before the council representing Juanita Alumbaugh at 66 E. <br />Main Street for a rezone from R-1 to R-3 and restricted to not more than three units. The <br />Plan Commission favorably recommended the rezone onto the council with one member <br />opposed and another member wanting more time to investigate the situation. This <br />property is in the process of being sold. Councilman Bryant said he had wanted more <br />time because there had been a variance far R-3 and he didn't know at what point when <br />structural changes were made, then does that mean ante it changes it has to stay. <br />Attorney Currens informed the council this was in existence prior to our Zoning <br />Ordinance, so it is anon-conforming use. Councilman Bryant said he just needed to <br />understand the situation and haw it needed. to be voted on. The parking is paved off <br />street parking and the property has greater than our ordinance stipulates. A motion was <br />made by Councilman Clark with a second by Councilman Shields to approve the rezone <br />R~1 to R-3. Motion carried S-0. A motion was made by Councilman Clark with a second <br />by Councilman Shields to approve Ordinance #2, 2005. Motion carried 5-0. <br />
