~R.7 <br />February 4, 2003 <br />The Mooresville Town Council met in regular session on Tuesday, February 4, 2003, at <br />6:30 P. M. at the Mooresville Town Hall. <br />Town council members present: President Toby Dolen, Troy Bryant, John L. Clark, Tom <br />Worthen, and Mark Mathis. No members were absent. Town attorney Tim Currens was <br />present. Mark Mathis gave the invocation. <br />Motion was made by Councilman Worthen, second by Councilman Bryant to approve the <br />manures of the January 21, 2003 meeting. Motion carried S-0. <br />First on the agenda was the Morgan County Historical and Geneology Association . Dale <br />Gray and Helen Windermuth reported to the Town Council on the project to restore the <br />old Methodist Cemetery located on West Washington Street. The association had <br />received a grant from the Community Foundation. xn the amount of $1,000. Operation <br />Round-up had turned them down for a grant. The project cast is $6200, with one-half of <br />the time of Ms. Windermuth donated and 100% of the time of Dale Gray donated. Ms. <br />Gray said the next step was to have a public program around the first of March to appeal <br />for funds and they needed written permission from the Town Council to work on the <br />Cemetery. Motion was made by Councilman Worthen, second by Councilman Clark to <br />give permission to the Historical and Geneology Association to work on the old <br />Methodist Cemetery. Motion carried S-0. Town attorney Tim Currens will have a <br />Resolution drawn. <br />Next, Nedra Parsons, 28 & 29 Meadow Lane in Boyd Heights spoke to the council about <br />septic problems. The State Board of Health had given her thirty days to get the problem <br />solved. They had told her to contact Toe Beikman and asked to be put on the council <br />agenda. She also talked to Mark Mathis. Councilman Mathis suggested to the council <br />that since Boyd Heights was not in the town limits, the town would request 100 % <br />annexation and we would run sanitary lines. Councilman Mathis said that South Johnson <br />Road could also be included. President Dolen agreed and once they were annexed, Food <br />and Beverage Funds could be used. Mrs. Parsons asked how to proceed. Tirn Currens <br />will get a form together for her to take to the homeowners. She asked Councilman <br />Mathis if he could call the State Board of Health and explain what is attempting to be <br />done. Councilman Mathis will contact the State Board of Health. <br />Andrea Guisbert wrote a letter to the council reguesting a "SLOW' or "CHILDREN AT <br />PLAY" sign on Peaceful View Drive in Rooker Run addition. Street Superintendent Joe <br />Beikman told the council that signs that have be erected have been done so by the <br />homeowner's associations. Rooker Run does not have an association. The sign and post <br />would cost approximately $60 to $70 dollars. Motion was made by Councilman Mathis, <br />second by Councilman Clark to install this sign. Motion carried 5-0. <br />Next on the agenda was a rezone from R-1 to R-3 far Herb and Linda Asher at 103 West <br />High Street. The Ashers were not present. Robert Williamson told the council they <br />Ashers had already built a second apartment with the exterior finished but the interior <br />was not completed.. This rezone was tabled to the February 18`~ meeting and the Clerk- <br />Treasurer will try to contact the A.shers to inquire about their intentions. <br />Jeff' Banning of Banning and Associates appeared before the council along with Richard <br />Henderson from Arbor Homes to request a rezone from Agriculture to R1-D and R1-C <br />for the property on Hadley Road owned by the Jessups. Richard Henderson spoke first <br />telling the council they had originally filed as R1-D in July 2002. Due to concerns of the <br />Plan Commission they asked Arbor Homes to come back as a PUD. A PUD was filed for <br />the August 22, 2002 Plan Commission meeting with 2461ots, they were granted a <br />continuance and then the PUD was denied. Arbor Homes went back to Grandview to <br />come up with a compromise, but couldn't come to a final one, so they made changes and <br />brought to. the Plan Commission an R 1-C and R 1-D f ling with R 1-C on all exterior lots <br />and R1-D in the interior. Additional standards had been added: Rl-C minimum of 1400 <br />
