MINUTES OF THE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regular <br />meeting on December 19, 1990, at 7:00 p.m. Present were Board <br />Members Don Barry, Vernon Kimmel, and Robert Tucker. The only <br />item on the agenda was the application of BPS Corporation for a <br />special exception to operate a used car lot located at East Main <br />Street, lots number 4, 5 and 6 in block #~4 of Mooresville, <br />Indiana. <br /> <br /> The Plan Commission had advised the Board of Zoning Appeals <br />that the proposed special exception, its location and character, <br />would not adversely affect the master land use plan. <br /> <br /> Samuel R. Korn, counsel for BPS Corporation, proceeded with <br />the presentation of this case. He pointed out that the land would <br />be used as an automobile used car lot which is consistent with two <br />other car lots in the immediate vacinity and the other general <br />business uses in the district. There were no remonstrators from <br />the floor present and the Board proceeded to a discussion. The <br />Board then made the following findings: <br /> <br /> 1. That the establishment, maintenance, or operation of the <br /> special exception as a used car lot would not be detrimental <br /> to or endanger the public health, safety, morals or general <br /> welfare since it was not inconsistent with other uses in the <br /> area. <br /> <br /> 2. That the special exception would not be injurious to the <br /> use and enjoyment of other properties in the immediate <br /> vacinity for the purposes already permitted since there were <br /> other used car lots in the area and the other uses in the area <br /> were similar. <br /> <br /> 3. The establishment of the special exception would not <br /> impede or substantially alter the normal orderly development <br /> and improvement of the surrounding properties for the uses <br /> permitted in the district due to the similar uses in the <br /> district. <br /> <br /> <br />
