MINUTES OF THE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met for its regular <br />meeting on Wednesday, November 2~, 1990, at 7:00 p.m. at the <br />Mooresville Town Hall. Present were Board Members Don Barry, Vern <br />Kimmel, Alan Kramer, and Robert Tucker. The Board's Attorney, <br />Timothy C. Currens, was also present. Chairman Barry determined <br />there was a quorum present and proceeded with approval of the <br />minutes of the prior meeting. <br /> <br /> The first item on the agenda was the request by David E. <br />Neathery concerning the property at the southeast corner of Bridge <br />Street and Highway 67, requesting a variance from the development <br />standards for a sign set-back from 60 feet to 30 feet and a canopy <br />extending from the service station front from 40 feet to 38 feet. <br />Drawings were presented and the Board proceeded with a discussion. <br />Bob Tucker asked why the sign could not be moved south. <br /> <br /> Roger Caperton, who was present for Mr. Neathery, advised that <br /> there was a drainage ditch which would put the sign down in a hole <br /> and in a less solid base. The drawings were reviewed and it was <br /> determined that the canopy might well be within the 40 foot set- <br /> back area; however, the representative of the petitioner advised <br /> that these were prefabricated buildings and could not be changed <br /> so the variance was being requested. The Board then proceeded to <br /> findings of fact on the canopy set-back variance from 40 foot to <br /> 38 feet. The Board found the following: <br /> <br /> 1. That the approval would not be injurious to the public <br /> health, safety, morals and general welfare of the community <br /> due to the location of this property and the insignificant <br /> set-back variance. <br /> <br /> <br />
