2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner due to the nature of the set- <br />back and use adjoining State Road 67. <br /> <br />3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use <br />of the property as a service station which is an appropriate <br />use under the zoning ordinance. <br /> <br />A motion was then made by Alan Kramer to approve the variance <br /> <br />on the canopy from 40 feet to 30 feet. This was seconded by Vern <br /> <br />Kimmel and unanimously carried. <br /> <br />The Board then proceeded to findings of fact on the variance <br /> <br />request for a sign set-back from 60 feet to 30 feet. <br /> <br />1. The Board found that the approval would not be injurious <br />to the public health, safety, morals or general welfare of <br />the community due to the location of this sign on the <br />property, a service station adjoining State Road 67. <br /> <br />2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner due to the nature of the zoning <br />and open areas adjoining this area. <br /> <br />3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use <br />of the property as a service station based upon the drainage <br />areas adjoining the highway. <br /> <br />A motion was then made by Robert Tucker to grant the variance <br /> <br />request from 60 feet to 30 feet on the sign. This was seconded by <br /> <br />Vernon Kimmel and passed by a vote of 4 in favor and 0 opposed. <br /> <br />There being no further business to come before the Board, the <br /> <br />meeting was adjourned. <br /> <br />Robert Tucker, Secretary <br /> <br />Don B~rry, C~ai--rman ~ <br /> <br /> <br />
