MINUTES OF THE BOARD OF ZONING APPEALS The Mooresville Board of Zoning Appeals met for its regular meeting on September 19, 1990 at 7:00 P.M. at Mooresville Town Hall. Present were board members Don Barry, Vern Kimmel, Robert Tucker, Alan Kramer, and Steve Oschman. Standing in for board attorney Timothy C. Currens was attorney Michael A. Ksenak. The board proceeded to approve the minutes of the August meeting. The only item on the agenda was the application of Caperton Development Group, Inc. for a sign variance for the placement of two signs on the Town Center property. Roger Caperton advised that the ordinance requires the sign to be 30 feet from the property line and there is only 20 feet in the proposed construction plans. He said the Town Center sign is 60 feet from highway 67 but only 20 feet from Bridge Street. He said the sign would be 30 feet high and over 100 square feet in size. He stated that the base of the sign would be 13 feet off the ground and the ordinance requires a minimum of 8 feet. The Burger King sign will be 20 feet in from the property line and 20 feet off of state road 67. Steve Oschman asked why so close to the road. Roger the Burger King sign was being placed Caperton advised that there was limited space available and commented that the sign had to be on the peremiter of the property and on a landscaped area. Mr. Caperton advised that he had to take some additional landscaped area for use in the parking lot to meet the minimum parking space per seat requirements. He further advised that with regard to the Town Center sign, that it was the best appropriate spot for overall view.
