Robert Tucker advised that the reason for the setbacks in the <br />ordinance was so that the sign would not overwhelm oncoming traffic. <br />Don Barry interjected that the Town Center sign would be approximately <br />130 feet from the highway. Mr. Caperton advised that the only entrance <br />into the area would be off of Bridge Street and the sign should not <br /> <br />cause any obstruction problem. <br /> <br /> The board moved to consider the variance from development standards <br />required under I.C. 36-7-4-918.5: <br /> <br /> 1. With regards to the requirement that the approval will not <br /> <br />be injurious to the public, health, safety, morals and general welfare <br />of the community the board found that both signs would be in a <br /> <br />location sufficiently distant from any moving <br />cause any visibility or other problem; <br /> <br /> 2. With regards to the requirement that <br />the area adjacent to the property include <br />be effected in this substantially adverse <br />the nature of the signs in question would <br /> <br />vehicles as to not <br /> <br /> the use and value of <br /> <br />in the variance would not <br />manner, the board found that <br />be allowable in this <br /> <br />classification and the relocation of each of the signs as required <br /> <br />by the applicant would not have any effect on any adjoining property; <br /> <br /> 3. With regards to the third requirement that the strict applicat- <br />ion of the terms of the zoning ordinance would result in practical <br />difficulties in the use of the property, the board found given the <br />overall layout of the property that: <br /> <br /> a. to place the Burger King sign consistent with the requirements <br />of the ordinance would cause the development not to meet the minimum <br />parking space per seating requirements and, <br /> <br /> b. to require placement of the Town Center sign consistent <br /> <br />with the ordinance would affect the current drainage design. <br /> <br />-2- <br /> <br /> <br />
