There being no further business to come before the Mooresville Town Council at this time, a <br /> motion was made by Councilman Cook with a second by Councilman Clark to adjourn the <br /> meeting. Motion carried 5-0. <br /> The next meeting of the Mooresville Town Council will be April 21, 2009 at 6:30 P. M. at the <br /> Mooresville Government Center. <br /> Mar arris, wn Council President <br /> ATTEST: <br /> IL <br /> Sandra R. Perry, Cler -Treasurer <br /> April 21, 2009 <br /> The Mooresville Town Council met in regular session on Tuesday, April 21, 2009, at 6:30 P. M. <br /> at the Mooresville Government Center. <br /> Town Council members present were: President Mark Harris, Vice-President Jeff Cook, John L. <br /> Clark, and Ryan Goodwin. Tony Langley was not present. Town attorney Tim Currens was <br /> present. <br /> Councilman Goodwin asked for prayers for the extended family of Sally Dolen wife of Toby <br /> Dolen, former town council member. <br /> John Crump, Mooresville Church.of God, gave the invocation. <br /> A motion was made by Councilman Clark with a second by Councilman Goodwin to approve the <br /> minutes of April 7, 2009 meeting. Motion carried 4-0. <br /> A motion was made by Councilman Clark with a second by Councilman Goodwin to approve a <br /> hook on to the wastewater for Karen Hancock at 5121 East County Line Road. Motion carried <br /> 4-0 <br /> Joe Beikman, Street Superintendent, will get back with the council on the feasibility of street <br /> lights at Brookmore Addition at the next meeting. <br /> Town Council President Mark Harris announced Pioneer Park and the Town was putting on the <br /> fireworks display at Pioneer Park. Mr. Jones put on a good show last year and has been asked to <br /> comeback this year. The cost will be split $10,000 out of Town Hall Budget and $10,000 out of <br /> Park and Recreation Budget. A motion was made by Councilman Cook with a second by <br /> Councilman Goodwin to approve. Motion carried 4-0. A motion was made by Councilman <br /> Cook with a second by Councilman Clark to appoint Town Council President Mark Harris as <br /> signatory on the contract. Motion carried 4-0. <br /> Chris Gale, HNTB, appeared before the council to give an update on the UV System project and <br /> the Mooresville Wastewater Treatment Plant. There was a change order from Thieneran for <br /> $7,076.00 for an additional four days needed on the contract. The project is approximately half- <br /> way completed. Chris Gale then updated the council on the work completed. He said he thought <br /> that overall Thieneman had done an adequate job. Some steel troughs had been delivered that <br /> did..not meet contract drawings or shop drawings. They made some modifications and the <br /> troughs still did not fit. The gaskets then did not fit on the UV tank, this work will have to be <br /> completed-after November 1 st. Thieneman had hurried up some things to meet compliance with <br /> our permit and they were not done properly. The council thought Thieneman should know about <br /> this and they asked Chris Gale to meet with the town attorney Tim Currens about the contract <br /> having a clause for liquidated delay damages of$11,200 for each day after the completion date, <br /> but Chris Gale said HNTB had told Thienemen concerning this problem and that Thieneman <br /> knows they are not going to meet their May 21s`completion date.
