Mel Paris said he had been a police officer since 1981and he thought the <br /> council should do the right thing and approve the buyback. <br /> Councilman Goodwin stated that in principle, the buyback should be done. But, the money has <br /> not been appropriated. The LOIT tax was adopted to protect a budget shortfall, if not in 2009 <br /> then 2010. There is approximately$563,000 in LOIT from this year. The LOIT distribution is <br /> likely to get smaller due to decreasing jobs and unemployment rising. There has already been <br /> $100,000 taken from the General budget and allocated to pay from LOIT to pay for current <br /> pension costs. He said he had a job to do as an elected official and his decision is based on the <br /> economic uncertainty and the fact the State had not approved the 2009 budget as of yet. The last <br /> thing he wanted to do was to pass on the buyback and there not be the money to pay for it. Doug <br /> Allen asked if the council just took out the$100,000 from the General budget or if they opted to <br /> take out the money. Councilman Goodwin replied the$100,000 taken out was to offset other <br /> additions to the 2009 budget, such as adding three more employees in the Fire Department. <br /> Councilman Cook closed the questions and comments. A motion was made by Councilman <br /> Clark to approve Resolution 16, 2008,buying back to hire date for the 1977 Police and Fire <br /> Pension for seven police officers in the amount of$341,088. Councilman Cook made the <br /> second. The vote was two to two, Councilman Goodwin and Councilman Langley opposed and <br /> Council President Harris unable to vote. At this time Attorney Currens stated a statute in case of <br /> a tie vote the Clerk-Treasurer voted to break the tie. Clerk-Treasurer Sandra Perry voted in <br /> favor of the buyback. Motion then passed 3-2. <br /> Ross Holloway, Holloway Engineering,presented a rezone from B-2 to B-3 for the old Pizza Hut <br /> building on South Indiana Street owned by Jack Ward. The Plan Commission sent a unanimous <br /> recommendation for the rezone to the Council. A motion was made by Councilman Clark with a <br /> second by Councilman Langley to approve the rezone. Motion carried 5-0. <br /> A motion was-made by Councilman Clark with a second by Councilman Goodwin to sign and <br /> send a letter to INDOT concerning rerouting traffic around downtown Mooresville. Motion <br /> carried 5-0. <br /> Town attorney Currens presented Salary Ordinance 15, 2008,based on figures from the last <br /> Town Council meeting. A motion was made by Councilman Clark with a second by Councilman <br /> Goodwin to approve the draft subject to any changes needed in figures. Motion carried 5-0. <br /> Attorney Currens told the council a representative was needed from the council to meet with <br /> SDG on the master plan and 1-69. Councilman Langley made a motion to nominate Councilman <br /> Goodwin to be the representative. Councilman Cook made the second. Motion carried. <br /> A motion was made by Councilman Clark with a second by Councilman Cook to approve a <br /> contract for Town attorney Curren for 2009 at$180.00 per hour. Motion named 5-0. <br /> Animal Control Officer, Mark Taylor reported seventeen(17) calls, three(3) impounds, and <br /> three(3)returns. For the entire year, five hundred forty calls (540), one hundred eighty five <br /> (18 5)impounds, and one hundred forty(140)returns. <br /> The Park is closing on Belle Romaine's property later this week. <br /> A motion was made by Councilman Clark with a second by Councilman Langley to approve <br /> payment of claims. Motion carried 5-0. <br /> There being no further business to come before the Town Council at this time, a motion was <br /> made by Councilman Cook with a second by Councilman Clark to adjourn the meeting.
