MOORESVILLE BOARD OF ZONING APPEALS <br /> MINUTES <br /> THURSDAY, FEBRUARY 14, 2002 <br /> The Board of Zoning Appeals met on Thursday February 1.4, 2002, at 7:30 P.M. at the <br /> Mooresville Town Hall. <br /> Member present were: Alan Kramer, Vice Chairman,Mike Young, Don Barry, and Jon <br /> Swisher. Jeff Justus was absent. Town Attorney, Tim Currens,was present. <br /> Motion was made to approve the minutes of the January 10, 2002 meeting by Don Barry, <br /> second by Jon Swisher. Motion carried 4-0. <br /> Next on the agenda was Leonard Scott, 697 Indianapolis Road requesting a Special <br /> Exception to build a church on property zoned agricultural. Representing Mr. Scott, was <br /> Mr. Mark Peden of Foley, Foley, and Peden, 60 E. Morgan;Martinsville, IN, he stated <br /> The New Hope Full Gospel Church is now meeting in a garage on Pennington Road, and <br /> with a congregation of 50 they are out growing their present location,the Scott's as <br /> members of the church would like to afford the church with the opportunity to use their <br /> property to build. With the property now zoned agricultural they need only to apply for a <br /> Special Exception. The property in question at one time had a house on three acres with <br /> two out buildings, the house burned six or seven years ago and the two out buildings will <br /> be removed when the church is built. The net result will be an improved to the property <br /> and they feel this would be a plus for the neighborhood. The church members have taken <br /> up a collection and have come up with sufficient funds to get started. The hope is to <br /> break ground and get started on building in a month or so. The type of building will be a <br /> pole type structure with plans to brick it in the future. The first criteria of the ordinance <br /> for a Special Exception is the operation will not be detrimental or dangerous to public <br /> health, safety, morals or general welfare. This being an applaication for a church it <br /> should meet these criteria. The church should help promote the morals and general <br /> welfare of the community. Second criteria the Special Exception should not be injurious <br /> to the use and enjoyment of the other properties in the immediate vicinity for purposes <br /> already permitted. In the immediate vicinity there are two churches, a Masonic lodge, <br /> and on the same side of the street is the Town Park and Nice-Pac property, which is, <br /> zoned Industrial use. So it is difficult how a small to medium side church would be <br /> injurious to the enjoyment of any other property in that vicinity. The third criteria are the <br /> proposed project would not alter the normal orderly development of improvement of the <br /> surround property for uses permitted in the district. The building of the church would not <br /> interfere, prevent, or alter the normal use of the property or the orderly development of <br /> the area. The fourth criteria are adequate facilities for sewage, drainage, access road <br /> and any other facilities being provided. The church will provide a septic systems <br /> according to the requirements specified in local and state health department. Access road <br /> is on a straight road, which should have good visibility up and down the road, so at that <br /> location the entrance in an out should not be a major factor as far as the road is <br /> concerned.
