MOORESVILLE BOARD OF ZONING APPEALS MINUTES <br /> i MARCH 13, 2003 <br /> The Mooresville Board of Zoning Appeals met on March 13, 2003 at 6:00 P.M. at the <br /> Mooresville Town Hall. <br /> Board member present were: Alan Kramer, Chairman,Mike Young, Chris Crouch, Don <br /> Barry, and Jon Swisher. Town Attorney Tim Currens was absent. <br /> Motion was made by Don Barry, second by Chris Crouch, to approve the minutes for the <br /> February 13, 2003. Motion carried 5-0. <br /> First order of business was Holloway Associates representing Bartley, Perkins, Tidd and <br /> Perry-Fisher requesting a Special Exception on what will bey, art of Lot 4B, 4E, and 4H at <br /> Southbridge Crossing, which will be one lot when the Plat 2recorded.He stated there <br /> would be a fenced in area behind and to the side of the building. The Plan Commission <br /> approved the replating of the PUD to create the new lot and a site plan for a building that <br /> has some uses, but not this use. That is why they are requesting the Special Exception in <br /> a B3 zoning. Southbridge is a PUD with a B3 underlined zoning. Mr. Holloway said the <br /> special exception is for an automotive body repair and associated uses. He that a special <br /> exception requires some things they have to meet, so he would go over the requirements. <br /> The first is a special exception can be granted upon the establishment, maintenance, <br /> operation of the Special Exception will not be detrimental to or endanger the public <br /> health, safety, morals, or general welfare, they contend that the automotive repair fits in <br /> with the area. With Big O Time right next door, on the other side of the railroad tracks is <br /> Block Company, which is Industrial use, and they think right there next to the railroad <br /> tracks this type of operation would,)e,_detrimental. <br /> (-- r,nt <br /> The Special Exception will not be injurious to the use and enjoyment of other properties <br /> in the immediate vicinity for the purposes already permitted and they have just described <br /> the companies and feel they are compatible with those companies, so would not be <br /> injurious. <br /> The Special Exception will not impede or substantially alter the normal and orderly <br /> development and improvement of surrounding property for uses permitted in the district: <br /> and he noted that this was the last property before the railroad, so the only development <br /> that could take place is on the lot that is already platted and that is where the Ace <br /> Hardware and the strip mall are now. Except for some uses that would be contemplated <br /> for expansion of the Ace Hardware for instance all the other lots have been developed. <br /> So the do feel this should have any impact of the development of the area. <br /> Adequate utilities, access roads, drainage, and other necessary facilities have been for are <br /> being provided; and this site is provided with city water and sanitary sewers. It has a <br /> paved street to it and access to Indiana Street and State Road 67. <br /> • <br />
