MOORESVILLE BOARD OF ZONING APPEALS <br /> MINUTES <br /> February 9, 2006 <br /> The Mooresville Board of Zoning Appeals met on Thursday, February 9, 2006, at 6:00 <br /> P.M. at the Mooresville Town Hall. <br /> Members present were: Jon Swisher, Mike Young, Charles McGuire, Alan Kramer and <br /> Don Barry. Tim Currens, Town Attorney, was absent. <br /> Motion to approve the minutes of the January 12, 2006 was made by Charles McGuire, <br /> second by Don Barry. Motion carried 5-0. <br /> Ross Holloway, Holloway Engineering, representing Bill Sodrel, requested a variance for <br /> setbacks for front and rear at Old St. Rd. 67 and Eastwood Drive at Sundown Manor. <br /> The variance if for the front setback from 40' to 35' and the rear setback if from 40' to 8', <br /> the lot is 16,275 sq. which meets requirements for a B-1 zoning. They are proposing a <br /> building for professional offices and the building would be 30' X 74' and 2,220 sq. R and <br /> there will eleven parking spaces with one being for handicap parking. There will be a 10 <br /> foot space between parking and the building which will allow for a sidewalk and green <br /> space. The area south of the building would be for green space and the area north meet <br /> the requirements for setback. They are asking for a variance for front and rear setbacks <br /> with the stipulation the property only be used for professional offices and that they will <br /> request and rezoning to B-1. The building will be full brick, 8/12 pitched roof, and <br /> dormers. This is the most economical use for this space and will be a benefit to the <br /> community. <br /> Mr. Swisher asked if there were any questions from the board, since there were no <br /> questions, he asked if there were any questions from the floor. Mr. Don Brock, 112 <br /> Sundown Manor, said he did not know how they could put that large of a building on the <br /> lot with the sewer line. He wanted to know if they would mow the lots. Mr. Holloway <br /> said they would be 20' feet from the sewer line in question and that they would mow the <br /> unused lot. <br /> Mickey Spoon, 200 Sundown Manor, said that when they bought the property in 1958 <br /> that the property in question was to be used for utilities only. Said they tried to buy the <br /> property and was told they could not buy it for it was for utilities only. He also wanted <br /> to know how they could build over the utilities. Mr. Holloway said that they had the <br /> building situated so it was not over the utilities and that they could put the parking lot <br /> over the utilities and that they would have to replace the parking lot at their cost it there <br /> was a problem with the sewer lines. <br /> Kay Norris, 229 Sundown Manor, said they had tried to buy the property and was told <br /> that nobody could buy it. She had a letter dated July 6, 1993 which she gave to Mr. <br /> Swisher to read to the board. Mr. Holloway showed the board a plat map of the area and <br />
