TOWN OF MOORESVILLE <br /> BOARD OF ZONING APPEALS <br /> NOVEMBER 12, 2009 <br /> MINUTES <br /> The Town of Mooresville Board Of Zoning Appeals met on Thursday November 12, 2009. The <br /> meeting was held at the Government Center at 6: P.M. <br /> Members present were Chairman Neal Allman, Board Members Mike Young Allen Kramer and <br /> Ann Whaley. Tim Currens,the Town Attorney was also present. <br /> The meeting was call to order by Mr. Allman, at this time Mr. Allman asked for any questions or <br /> changes to the minutes from the October 8,2009 meeting. With no questions or corrections a <br /> motion was made by Mike young seconded by Ann Whaley to accept the minutes as written <br /> the motion carried 4-0. <br /> The first thing on the agenda was Keith and Jany Bradbury asking for a variance at 5168 E St Rd <br /> 144. Harvey Waddelow of Missions Alive was also was present. They are asking for a variance to <br /> utilize the back office building and barn for commercial use for their internet based order <br /> fulfillment center. The business is Who North America Inc. Mr. Bradbury's parents would live in <br /> the house as caretakers for the property. Mrs. Whaley asked if they were going to change the back <br /> building into an office building, Mr. Bradbury said that it would be used for their office as well as <br /> • storage of merchandise Mrs.Whaley wanted clarification as to why a variance was needed. <br /> Harvey Waddelow spoke to explain that when he bad to get a variance from Agriculture for his <br /> non for profit organization,and to live on the property as well. Mr. Currens asked about signing, <br /> The Bradbury's said that their sign would be 6 ft by 4 ft with a solar powered directional lighting. <br /> Joe Beikman asked what kind a merchandise would be stored, Mr. Bradbury said it would be <br /> toys,action figures and cd's from a TV program Mr. Who. Mr. Beikman said that they would <br /> also need a change of occupancy permit from the state for the business in question. After the <br /> reading of the facts of Findings a motion was made by Ann Whaley to approve this variance <br /> contingent on receiving change of occupancy from the state of Indiana and the signage not to be <br /> more than 4 by 6 ft.,the motion was seconded by Mike Young,the motion carried 4-0 with none <br /> opposed. <br /> Ross Holloway for Bill Sodrel asking for a set back variance on property to build a single family <br /> home. The property is a vacant lot in front of Sundown Manor, at Eastwood and Center Street <br /> This parcel is now zoned R1 which is residential single family. There has been research and title <br /> search to insure that a home can be built. The property now has 30 ft set backs,they are asking <br /> for a set back to 8 ft. on the East view Drive side.Mr. Holloway had aerial showing the lot set <br /> backs etc.the home would not be over 2100 square feet,(later he said that they would lower the <br /> square footage if necessary)Mike Young asked what convenience and restriction would be <br /> followed.Mr. Holloway said that Sundown Manor really does not have any,they would consent <br /> to any reasonable convenience or restriction necessary. Ann Whaley asked of Mr.Holloway, <br /> what set backs would cover sequent building on the north part of the parcel, Mr.Holloway <br /> answered by saying first of all only an accessory building could be built and the variance asked <br /> for would take in the entire length of the parcel. At this time Chairman Allman asked for <br /> questions from the audience; Don Brock of 112 Sundown Manor said that did not see how a <br /> house that big of a house there,he al so said that he was told when he bought nothing would be <br />
