Kay Norris of 229 Sundown Manor came forward to <br /> express her concerns; she said that the homes there are all 1,000 square feet and a home that size <br /> and she does not feel that it should be built there she also had safety issues with Old 67. Mrs. <br /> Whaley ask Mr. Holloway if this is a part of Sundown Manor,be said that it was not given a lot <br /> number but it is on the plat.He also that he did not know if it was originally ment to build on or <br /> not.Mr. Holloway did say that there was a Quiet Title Law suit to clean up the title,he also <br /> repeated that it is zoned R1. Mr. Holloway said that the maximum 21,000 square feet could be <br /> built on this property.Mr. Holloway said that with a variance this property has no value.Mr. <br /> Holloway feels that this is a reasonable request. Mrs.Whaley asked if the property owner has <br /> maintained the property, at that time Richard Willowy of Sundown Manor stood up to say that <br /> He and several residents had mowed this property.Lori Ball of 127 Sundown Manor also talked <br /> About the lot not being maintained and ask where they would put lawn mowers,yard tools etc. <br /> If there was not a garage or shed. At this time Mr. Holloway asked the Board to look at the map <br /> And pointed out that lot 7 is only about 20 feet from the property line and lot 1 only about 10 <br /> from <br /> their property line. Charles McGuire a past Plan Commission member, said that a few years ago <br /> he had a meeting with several of the neighbors of Sunset Manor and that at that time they were <br /> convinced that told that nothing would ever be built on the property in question.Nothing in <br /> writing has been found. Alan Kramer expressed safety concerns. A motion was made by Ann <br /> Whaley to deny the variance,Mike Young seconded the motion the vote was 4-0 to deny. <br /> Ross Holloway,for H Donald Stacy came to ask for 6 variances at 36 Lincoln Lane,to be able to <br /> have a minor plat being granted for selling value.variance 1} front set backs from 40 feet to 24 <br /> feet, 2] rear setbacks lots 1 &2 from 30 feet to7.00 feet, 31 side yard of lot 1 from 6 feet to5,41 <br /> width to depth ratio both lots to be greater than 2.5, 51 minimum lot width for lots 1 and 2 to be <br /> reduced from 65 feet to 57 feet and 61 for lots 1 and 2 to be less than 10, 000 square feet. The <br /> current 3 family dwelling would be a one family home Mr. Holloway said that he had Darrell <br /> Brown from the Mooresville Dept.to look at the proposed area he found no problem. Terry <br /> Burnside asked if all of the property was on Lincoln Lane,the answer from Mr. Holloway was <br /> yes Lincoln Only.After the reading of the Facts of Findings, a motion to approve the 6 variances <br /> By Mike Young per the statement of Mr. Currens { if the 6 variances is granted, along with that <br /> the use of lot 1 would be restricted to single family dwelling only and all be subject to the Plan <br /> Commission granting the Minor Plat.} a second came fro Alan Kramer,the vote was 4-0 in favor <br /> of the variances. <br /> Mr. Holloway came with Ross Beyer for Kroger Food Stores;for with 5 variances for Kroger <br /> Food stores;the variances are need to build a General Business {Gas Station} 1} variance from <br /> more than one structure on a single parcel; 21 to reduce the sign setback from 50 feet to 3; 31 to <br /> allow signs with intermittent/digital display;41 for parking space; and 51 to sign area of 265 <br /> square feet to which exceeds the 184 square feet allowed.Mr. Holloway explained why all of the <br /> variances were needed. Mr.Beyer has pictures of other Gas Stations. Mrs. Whaley asked about <br /> the entrance, it was explained that it was the existing drives and there would not be any new cuts. <br /> {There was some conversation that was not on the recording about the tanks etc.} The tanks have <br /> double walls, interior alarms if there is a leak.After the reading of the facts of Findings a motion <br /> was made by Mike Young seconded by Ann Whaley to approve this variance. The vote was 4-0 <br /> with none opposed. <br /> A motion was made by Mike Young to adjourn seconded by Ann Whaley all in favor of <br /> adjourning. <br />
