-r <br /> BOARD OF ZONING APPEALS <br /> MINUTES <br /> JUNE 9, 2011 <br /> The Town Of Mooresville Board of Zoning Appeals met on June 9, 2011 at the <br /> Mooresville Government Center at 4 E. Harrison Street. <br /> Members present were Chairman,Neal Allman, Alan Kramer,Amt Whaley and Mike <br /> Young. Town Attorney Tim Currens was present. <br /> The meeting was called to order by Chairman Allman. A motion was made by Alan <br /> Kramer and second by Mike Young to approve the minutes of the April,2011 meeting. <br /> Motion carried 4-0. There was no meeting held in May, 2011. <br /> The first item on the agenda was Holloway Engineering, representing Mr. and Mrs. Bill <br /> Bryant of 5640 E. Orchard Road, seeking a special exception to operate an auto repair& <br /> body shop in a B-3 zoning district. The Mooresville Town Council had approved the <br /> rezoning of this property at their meeting on June 7, 2011, from Ag to B-3. The <br /> Mooresville Plan Commission bad given a favorable recominendation to the Town <br /> Council for the rezone, for the purpose of operating a light vehicle repair shop. The <br /> zoning ordinance approved contained the following restrictions: no liquor or alcohol <br /> sales,no entertainment and no clubs. Automobile and light truck repair is permitted in a <br /> B-3, by special exception. The access will be off of 144 via a forty foot wide access and <br /> utility easement. There will be an agreement for maintenance for that drive between the <br /> various parties per a notarized private roadway agreement. A signed copy of the <br /> agreement was given to Tim Currens at the Plan Commission meeting. No one appeared <br /> at the council meeting to oppose the rezone. Mr. Holloway read the six items needed to <br /> approve a special exception and stated he felt there would be no reason for the board to <br /> deny the request. There were no questions from the audience or board members. After <br /> reading the finding of fact for a special exception, Chairman Allman asked for a motion. <br /> A motion was made by Mike Young to approve the special exception, with the <br /> restrictions listed in the recorded ordinance. Motion was second by Alan Kramer and <br /> carried 4-0. <br /> The next item on the agenda was Holloway Engineering,representing Neff rentals, <br /> seeking a variance at 223 Taylor Street to allow a 4-plex unit in a single family <br /> residential zoning district. Mr. Holloway gave the board members a handout of the <br /> proposed unit. The surrounding area has a mixed zoning, ranging from residential to light <br /> industrial. The house that used to be on the property has been torn down and there are no <br /> other improvements on the lot currently. There are already doubles and even a 3-plex in <br /> the area. They have allowed for thirteen parking spaces. Each unit in the proposed <br /> building has 840 square feet. Ann Whaley asked why they were asking for a variance <br /> and not a rezone. Mr. Holloway stated that for one,that would create spot zoning in the <br />
