MINUTES OF THE BOARD OF ZONING APPEALS <br /> <br /> The Board of Zoning Appeals met on Wednesday, May 16, 1990 at 7:00 P.M. <br />Present were board members Donald Barry, Vernon Kimmel, Alan Kramer, Robert <br />Tucker and Steve Oschman. Chairman Barry determined there was a quorum present <br />and proceeded to approve the minutes of the April 18, 1990 meeting. <br /> <br /> The first item on the agenda was the special exception use filed by Lee <br />Copeland, Dwayne M. and Mary Jane Copeland to expand the special exception use of <br />the White Lick Cemetery. John Mills was present on behalf of the owners. <br /> <br />Donald Barry read the letter from the Plan Commission determining that the special <br />exception would not adversely effect the Master Land Use Plan. Mr. Oschman <br />inquired from Mr. Mills as to the location of the cemetery and the property in <br />question. This information was supplied by attorney John Mills who also gave a <br />background of the cemetery and its current needs. <br /> <br /> The board then proceeded to its findings under chapter 5 Special Exception <br />Procedures as follows: <br /> <br /> 1. The board found the establishment, maintance and operation of the <br />special exception could not be detrimental to or endanger the public health, <br />safety, morals of general welfare due to the location of the variance and the <br />current existing use; <br /> <br /> 2. That the special exception would not be injurious to the use and enjoyment <br />of other properties in the immediate vacinity for the purposes already permitted <br />due to the current cemetery being in existence and this being a compatible use; <br /> <br /> 3. That the establishment of the special exception would not impede or <br />substantially alter the normal and orderly development and improvement of the <br />surrounding property for uses permitted in that district due to this use being <br />consistent with the area; <br /> <br />4. That adequate utilities, access roads, drainage and other necessary <br />facilities have been or are being provided as shown through the existing special <br /> <br /> <br />
