Re:

FINDINGS OF FACT
Dale & Matilda Jessup

This matter came before the Mooresville Board of Zoning
Appeals on February 21, 1990, at 7:30 p.m. at the Mooresville
Town Hall. The petition requested a variance from the use
to allow this property to be used for a two family residence.

The Board of Zoning Appeals having heard evidence on

the above captioned petition, now makes the following findings

of fact:

1. The approval would not injurious to the public health,
safety, morals and general welfare of the community due to
the size of the structure and its relationship to other
residential uses.

2. The use and value of the area adjacent to the property
included in the variance would not be effected in a
substantially adverse manner due to the type of use, the
consistency with other uses in the area, and the size of the
structure.

3. The need for the variance arises from a condition
peculiar to the property, namely, its prior use as two family
residential and the size of the structure.

4. The strict application of the terms of the zoning
ordinance would constitute an unnecessary hardship if applied
to this property based upon the size of the structure.
