Re: <br /> <br /> FINDINGS OF FACT <br />Dale & Matilda Jessup <br /> <br /> This matter came before the Mooresville Board of Zoning <br />Appeals on February 21, 1990, at 7:30 p.m. at the Mooresville <br />Town Hall. The petition requested a variance from the use <br />to allow this property to be used for a two family residence. <br /> <br /> The Board of Zoning Appeals having heard evidence on <br /> <br />the above captioned petition, now makes the following findings <br /> <br />of fact: <br /> <br /> 1. The approval would not injurious to the public health, <br /> safety, morals and general welfare of the community due to <br /> the size of the structure and its relationship to other <br /> residential uses. <br /> <br /> 2. The use and value of the area adjacent to the property <br /> included in the variance would not be effected in a <br /> substantially adverse manner due to the type of use, the <br /> consistency with other uses in the area, and the size of the <br /> structure. <br /> <br /> 3. The need for the variance arises from a condition <br /> peculiar to the property, namely, its prior use as two family <br /> residential and the size of the structure. <br /> <br /> 4. The strict application of the terms of the zoning <br /> ordinance would constitute an unnecessary hardship if applied <br /> to this property based upon the size of the structure. <br /> <br /> <br />
