The need for the variance arises from a condition
peculiar to the property, namely, its prior use as two family
residential and the size of the structure.

4. The strict application of the terms of the zoning
ordinance would constitute an unnecessary hardship if applied
to this property based upon the size of the structure.

5. The approval does not interfere substantially with the
comprehensive plan of the Town of Mooresville based upon the
type of use.

A motion was then made by Vernon Kimmel to approve the
variance from the use. This was seconded by Alan Kramer and
unanimously carried.

There being no further business to come before the Board, the

meeting was adjourned.

Secretary

Don Barry,

Chairman
