FINDINGS OF FACT

RE:

HARRY W. & VICKI A. LASITER
33 W. Washington Street
Mooresville, IN 46158

This matter came before the Mooresville Board of Zoning

Appeals on January 17, 1989, at 7:30 P.M. at the Mooresville Town

Hall. The petition requested a variance from the Subdivision

Control Ordinance to construct a single family dwelling.

The Board of Zoning Appeals having heard evidence on the

above captioned petition, now makes the following findings of

fact:

1. That the approval of the variance would not be injurious
to the public health, safety, morals, and general welfare of
the community since this use was certainly compatible with
the area.

2. That the use and value of the area adjacent to the
property included in the variance would not be affected in a
substantially adverse manner due to the lot size and proposed
use being consistent with the area.

3. That the strict application of the terms of the zoning
ordinance would result in practical difficulties in use of
the property due to the size of the ground, the fact that all
was consistent with the Master Land Use Plan and Subdivision
Control Ordinance standa/~"'~,

~b~ Barry, ~reside~t

Robert Tucker, Secretary
Dated: ~~ ~L~/~ !~C~
