Don Barry stated that there were
practical difficulties with using the.06 of an acre under our ordinance.
Chairman Tucker polled the board and received a consensus on the third
finding of fact. Don Barry then moved to grant the variance from a 40
foot rear setback to a zero setback. Alan Kramer seconded and the vote was
three in favor and one opposed. The variance was granted. Mr. Vaughn
raised the issue that the people who now own lot 19 were not notified,

Phil Smith advised that he had used the addresses from the Auditor's Office

for all mailings and that if there had been a transfer it was not recorded.

There being no further business to come before the meeting the board
adjourned upon motion duly made, seconded and unanimously carried.

Robert Tucker, Chairman~

-5-
